Expungement (Destruction of Court Records):
Records of delinquent (except for felony convictions) and CHINS juveniles must be destroyed after the juvenile has reached age 19, or after 5 years have passed since the person's last Juvenile and Domestic Relations District Court hearing: whichever event occurs later. In the case of felonies, the record is sealed in accordance with the event schedule mentioned before and then destroyed after 20 years have passed since the person's last Juvenile and Domestic Relations District Court hearing. Sealed records of felonies are accessible (open) to a restricted group of persons for very limited purposes. If a juvenile is found innocent of a misdemeanor offense, he or she may ask in writing for early destruction of the records. The right of expungement shall be further explained at the disposition hearing to juveniles found to be delinquent or to be in need of services.
